Why Following Smart Snacks Regulations Matters
Protecting Black Oak Mine Unified School District's FREE Universal Meals & CEP Program
The Smart Snacks in School standards are federal and state nutrition requirements that help create a healthier school environment by ensuring foods and beverages sold to students during the school day support good nutrition. These standards apply to foods sold outside of the reimbursable breakfast and lunch programs, including student stores, fundraisers, vending machines, and à la carte sales during the school day, which starts at 12 am and ends 30 minutes after school is let out.
As a Community Eligibility Provision (CEP) district participating in California's Universal Meals Program, Black Oak Mine Unified School District receives federal and state funding to provide nutritious breakfast and lunch to every student at no cost. Compliance with all USDA and California Department of Education (CDE) regulations—including Smart Snacks—is essential to maintaining these programs.
If our district is found to be out of compliance during a CDE Administrative Review, the district may be required to:
- Correct violations through a formal corrective action plan.
- Repay state or federal meal reimbursements for non-compliant food sales.
- Undergo additional monitoring or follow-up reviews.
- Risk findings that could impact future program funding or increase administrative oversight.
Every staff member plays an important role in protecting our meal programs. Before selling or distributing food during the school day for fundraising, classroom activities, or student organizations, please consult with the Food & Nutrition Services Department to ensure the items meet Smart Snacks requirements.
